Terms & Conditions
Please carefully read the Terms, Conditions & General Information contained in these pages. They outline the terms under which Touch Down DMC, Inc. will operate, and they limit our liability. Payment of deposit and/or final payment is an acknowledgement of receipt of these terms & conditions and constitutes acceptance of such as outlined. Touch Down DMC, Inc., is a Virginia corporation located in Arlington, Virginia.
Deposits, Payment terms, Final Payments and Reservations: A minimum deposit is due to Touch Down DMC, Inc. at the time of approval of Quotation. The deposit may vary depending on the tour being purchased and will be reflected in our Quotation. Full payment of any outstanding amount is due 90 days prior to the commencement of any of our tours unless otherwise stated in our Quotation.
Prices, Rates, Fares: Unless otherwise indicated, all prices shown are in US Dollars and are stated per person per tour. Prices may fluctuate from time to time and may be subject to change at any time prior to departure depending on the tour being purchased. Certain tour prices do not fluctuate. Price fluctuation policies are reflected in our Quotation. Airfares are not included in the quoted tour prices and any airfares which are stated are only examples and are not guarantees of available airfares.
Travel Documents: All participants must be in possession of a passport valid for at least 6 months beyond the re-entry while traveling abroad. A visa or visas may be required for some or all the countries visited on the tour. Please check your visa requirement/s at time of reservation. Touch Down DMC, Inc. will assist with current visa information, however, Touch Down DMC, Inc. recommends a reliable visa service that will assist in obtaining visa/s for a nominal fee/s. Non-U.S. Citizens may have different requirements. It is the passenger’s responsibility to ensure that all his or her visa and passport requirements are met. Please note that in the event travel advisories are issued by any government or applicable authority and the tour is not cancelled by Touch Down DMC, Inc., or by tour member (which will be subject to cancellation fees), the member assumes and accepts all risk of travel, related to the travel advisory or otherwise.
Tour Information: Acknowledgement of reservation will be sent immediately upon initiation of a reservation. Final tour documents are digitally delivered approximately 21-30 days prior to departure.
Cancellations & Changes: Touch Down DMC, Inc. reserves the right to cancel any tour at any time, and in such event the liability of Touch Down DMC, Inc. is limited to the return of monies paid to it by any tour member. Cancellations by clients are permitted with a fee laid out in our Quotation. Touch Down DMC, Inc. suppliers impose rigid cancellation fees; accordingly, please be aware that Touch Down DMC, Inc. will levy cancellation fees as laid out in our Quotation and they range from 10 to 30%. If cancellation is received within 90 days of departure, 100% of tour fee is non-refundable. All payments made to Touch Down DMC, Inc. are non-refundable and will be deducted from the cancellation fee. Note: All cancellations must be received by Touch Down DMC, Inc. in writing and shall be sent to: Touch Down DMC, Inc.: 3101 Wilson Boulevard, Suite 500 (PMB#780), Arlington, VA 22201. Notice may also be sent via email to linda@touchdowndmc.com. The reason for the cancellation must be stated in the notice, as your cancellation may be covered by your travel insurance policy if you have obtained one. To protect against cancellation charges, we strongly recommend purchasing Cancellation Protection and Travel Interruption Insurance (see Insurance clause). Touch Down DMC, Inc. and/or its third-party contracts and suppliers are not responsible for any damage, expense or inconvenience caused by late departures, security delays, change of schedule, or other acts or conditions excluded herein.
Unused Tour Items: No refund will be made for any unused accommodation, missed meals, transportation segments, cruise portions, sightseeing tours or any other service. Such unused items are neither refundable nor exchangeable (no exceptions). If passengers do not choose a travel date or do not travel within the allotted timeframe it will be regarded as unused tour items.
Insurance: Touch Down DMC, Inc. strongly recommends that you obtain Travel Protection Insurance, which will protect you and your investment in the event of a medical emergency before or during your trip and offers coverage for trip cancellation or interruption, government travel advisories, illness, injury, and damage, loss or theft of baggage, as well as on site emergency assistance. Such insurance is available from many sources including travel agents and other online insurance services. We also suggest that you review any existing health insurance coverage available to you to determine the level of coverage, if any, that you will have in a foreign country. Touch Down DMC, Inc. is not responsible for the costs of any medical treatment required during the tour, nor is Touch Down DMC, Inc. responsible for the quality, or lack thereof, of medical care a tour member may receive while on tour.
Health Requirements: Health regulations for some countries visited may require proof of inoculation and/or vaccination certificate; such a certificate should be in your possession throughout the entire tour. Touch Down DMC, Inc. strongly recommends that you consult with your personal physician or local travel clinic.
Transportation Terms:
Revision Fees: Any name changes to transportation or lodging reservations (including airline tickets) including minor spelling corrections may require that such reservations be cancelled and re-booked. Tour members agree that the names on the reservation form as given to Touch Down DMC, Inc. are spelled correctly per the tour members’ passports. If names as provided are incorrect then the tour member agrees to any expenses resulting from the cancellation and re-booking of such transportation and lodging reservations.
In Tour Transportation: Deviations to any planned motor coach, cruise or rail itineraries are possible, although every effort will be made to keep them as they are shown. All itineraries are subject to change without notice. Should conditions render transportation routes unsafe for navigation or passage, alternative services may apply, including but not limited to, alternate lodging accommodation and/or substitute transportation arrangements.
Tour Inclusions are as stated in our Quotation:
Accommodations: Accommodations will be provided at the property specified or similar. Rooms will be assigned by the respective supplier/s in accordance with their standard policies, in category/ries as specified in the itinerary.
Meals: Meals for each tour are as specified or similar. Please identify any dietary restrictions you may have prior to departure and in writing.
Sightseeing and Land Tour Services: The following services are as specified or similar: In-tour transportation, baggage handling, sightseeing with English-speaking guides and all entrance fees to attractions visited. Sightseeing will be via motor coach, private car and other modes of transportation (air conditioned where necessary and available), as determined by the nature of the terrain.
Special Entertainment: Cultural entertainment events, gala evenings and/or festivals are included as specified.
Tour Exclusions are as stated in our Quotation:
Your tour does not include: Air transportation (unless specifically stated as included); costs and fees to obtain or extend your passport/s; visa fees and processing fees; inoculations and vaccinations (if required); health certificate; airport taxes and country departure taxes (if applicable); all items of a personal nature including alcoholic beverages (except on certain occasions); meals not specified, tips to tour guides; excess baggage charges; cancellation, health, accident and baggage insurance; private, non-group transfers; and any items not specifically listed as included.
Non-refundable Air Tickets: For any departures that are not guaranteed: If you are purchasing a non-refundable air ticket, please make sure that you understand the difficulties associated with these airfares. Touch Down DMC, Inc., cannot be held responsible for any change/cancellation penalties associated with non-refundable airfares.
Luggage: In-tour ground travel arrangements include transportation and transfer of no more than two standard-sized suitcases per person. In-tour airline travel may restrict the size and number of luggage pieces, and/or impose additional charges which will be the responsibility of the tour member. Please be aware that airline restrictions on luggage vary by airline, location and custom in the industry. Touch Down DMC, Inc., will make reasonable efforts to notify you of any in-tour luggage restrictions prior to departure.
Baggage Risks: Baggage and personal effects are at owner’s risk throughout the tour and baggage insurance is strongly recommended (see insurance clause). Carrier liability for tour members’ baggage is clearly stated on the passenger contract printed on all tickets; description can also be found on carrier websites. Liability for checked and unchecked baggage shall in no event exceed the actual loss incurred by the passenger, subject to proof of the amount of loss, and Touch Down DMC, Inc. is in no way liable for any losses. Please read all the conditions of your ticket. Federal law and treaties limit the amount of recovery for loss of or damage to your luggage or its contents. To protect against such limitations, we strongly recommend that you purchase insurance (see insurance clause).
Photography: Touch Down DMC, Inc. reserves the right to take photographs during the operation of any program and to use resulting photographs for promotional purposes. Any passengers who prefer that their images not be used are asked to notify their tour escort at the beginning of the program.
Responsibility – Limitation of Liability: Touch Down DMC, Inc. act only in the capacity as a tour operator and arranges with third party contractors and service providers providing accommodations, transportation or other services to the tour member. Touch Down DMC, Inc. makes every effort to select quality suppliers of the aforementioned services. However, Touch Down DMC, Inc. does not control the operations of these third party contractors and suppliers and as a result, cannot be held liable for any personal injury, property damage, or other claim which may occur as the result of any and/or all of the following: (1) the wrongful, negligent or arbitrary acts or omissions on the part of the independent supplier, agent, its employees or others who are not under the direct control or supervision of Touch Down DMC, Inc.; (2) defects or failures of any vessel, aircraft, vehicle or other instrumentality which is under the control of an independent supplier; or (3) loss, injury or damage to person, property or otherwise, resulting directly or indirectly from any Acts of God, weather, government actions, dangers, incidents during transportation, fire, breakdown in machinery or equipment, or wars (whether declared or not), hostilities, civil disturbances, strikes, riots, thefts, pilferage, medical epidemics, quarantines, or customs regulations, defaults, delays or cancellations or alterations in itinerary and/or lodging due to schedule changes or capacities, from any causes beyond Touch Down DMC, Inc. control. Further, Touch Down DMC, Inc. is not liable for any loss or damage resulting from insufficient or improperly issued passports, visas or other legal documents. Regardless of anything herein to the contrary, tour members agree that maximum liquidated damages shall not exceed the tour price. In no event shall the liability of Touch Down DMC, Inc. exceed the actual cost of any services not provided and Touch Down DMC, Inc. hereby disclaims any responsibility for revisions, substitutions, and omissions which are the result of the actions or inactions of any third parties providing services or products for the applicable tour. The tour member further agrees that Touch Down DMC, Inc. shall not be liable for or responsible for other consequential losses or other damages or expenses that the tour member has incurred in anticipation of or in connection with the tour.
Reservation of Rights: Touch Down DMC, Inc. (when deemed necessary in its sole discretion) reserves the right to: (1) cancel any itinerary or any part of it for any reason; (2) make any alterations to the itinerary (including, but not limited to, alterations or substitution of hotels); and (3) decline to accept or to retain any person as a tour member should such person’s health, mental or physical condition, in the sole opinion of Touch Down DMC, Inc., impede the operation of the tour of the other passengers. Tour members may be restricted by Touch Down DMC, Inc. or third-party services providers or applicable law or regulation from smoking, certain behaviors, photography or other actions due to cultural issues and enjoyment of the tour by other tour members. Tour members are held responsible for being in sufficient good health and capacity to undertake the tour. Persons needing individual assistance for walking, dining, or other personal needs must be accompanied by an able companion and must notify Touch Down DMC, Inc. in writing at the time of booking. Certain trips and features may not be wheelchair accessible. If you require a wheelchair, you must provide your own small collapsible wheelchair. Touch Down DMC, Inc. cannot guarantee wheelchair accessibility. If a tour member is asked to leave while the tour is in progress, due to any condition or action that becomes a nuisance to other tour members or detrimental to their enjoyment of the tour, that person will be responsible for charges incurred on account of such departure from the tour and/or their return to their Country of residence. In such a case, Touch Down DMC, Inc. will use its best efforts to obtain a refund of any monies that can be recovered for the unused portion of the tour, considering additional charges incurred by Touch Down DMC, Inc. and cancellation or modification charges of third parties. There can be no guarantee that any such sums can be recovered or refunded. Other than refunding such sum, Touch Down DMC, Inc. will accept no further liability or obligation toward that person or third party.
Disclaimer: Touch Down DMC, Inc. is not responsible for any errors, omissions, or misquotes contained in any promotional documentation. The contents of promotional documentation may be changed at any time (including, but not limited to, rates and itinerary) without notice and at the sole discretion of Touch Down DMC, Inc. In the event that an error or omission committed by Touch Down DMC, Inc. or its employees results in the paid booking of the tour member on an incorrect promotional tour, price, date, or other similar error, Touch Down DMC, Inc. reserves the right, when practicable, to re-invoice with correct pricing and the tour member agrees to be subject and bound to the subsequent price, or the tour member may also elect to receive a full refund for all monies that have been paid to Touch Down DMC, Inc. in such an event. The tour and stipulated members further agree that Touch Down DMC, Inc. shall not be responsible or held liable to secure the originally intended promotional tour, which in many cases may not be available or its procurement may not be practicable due to forces of nature, market factors, or other related reasons.
Venue: It is specially agreed that this agreement is entered into in North America. In the event any legal or equitable action is brought against Touch Down DMC, Inc. concerning the interpretation, enforcement or breach of any term, obligation or duty as contained or related to the terms and conditions set forth in this web site, or pursuant to law, statute or treaty to which North America is a signatory, the venue of such action shall lie here exclusively.
Choice of Law: It is specifically agreed and stipulated that the Virginia State law shall govern and apply to any legal or equitable action brought against Touch Down DMC, Inc. concerning the interpretation, enforcement or breach of any term, obligation or duty contained in this web site, or pursuant to any law, statute or treaty to which United States is signatory.
Privacy Policy: Your privacy is important to Touch Down DMC, Inc. Your e-mail address, name, street address and telephone number are stored in our database. Touch Down DMC, Inc. will not sell, rent, trade, or give your name, e-mail address, street address or any other personal information to any other organization unless you give Touch Down DMC, Inc. permission. However, Touch Down DMC, Inc. reserves the right to release information to the appropriate authorities if we believe that such release is reasonably necessary to comply with the law or to protect the property or safety of Touch Down DMC, Inc. or any of its affiliated companies, our employees, users, or others. Changes and Addendums to the Contract: No changes to the contract, and or any addendum thereto, are enforceable unless reduced in writing and signed by all parties.
